1. Overview
These Terms of Service govern your access to and use of Proovl.com, operated by 2Way OU and referred to in these Terms as “Proovl.”
Proovl is a service designed to enable SMS receiving and SMS sending online.
Proovl does not provide voice calling, mobile data, internet access, emergency calling, or any telecommunications service outside the SMS functionality described on Proovl.com.
By creating an account, you agree to these Terms.
If you do not agree to these Terms, you must not use Proovl.

2. Your Account
Your Proovl account is personal to you.
You are responsible for keeping your login credentials secure and confidential.
You may not sell, rent, share, transfer, sublicense, or otherwise provide access to your account, KIT, Credit, or any Proovl functionality to any third party.
You are responsible for all activity that occurs through your account.

3. Credit
To pay for Proovl services, you purchase Credit.
Credit is added to your Proovl account balance after your payment is confirmed.
Credit is an internal service balance that can be used only within Proovl.
Credit is not money, electronic money, currency, cryptocurrency, stored value, a payment instrument, or a financial product.
Credit has no value outside Proovl and cannot be converted into cash, cryptocurrency, or any currency.
Credit cannot be withdrawn, exchanged, transferred to another account, or used outside Proovl.
Purchased Credit is valid for six months from the date it is added to your Proovl account balance.
Expired Credit is automatically removed from your account balance and cannot be restored, refunded, transferred, exchanged, or recovered.
When you purchase new Credit, the expiration date of your remaining balance is extended to match the expiration date of the newly purchased Credit.
Credit in accounts with active Premium Status does not expire while Premium Status remains active.

4. Premium Status
Your account may receive Premium Status after a single purchase of 1,000 Credits.
To maintain Premium Status, each subsequent Credit purchase must be for at least 1,000 Credits.
While Premium Status remains active, Credit in your account does not expire.
Premium Status does not waive your obligation to follow these Terms, KYC requirements, acceptable use rules, SMS limits, payment rules, or any other Proovl requirements.
Proovl may change Premium Status eligibility, benefits, or availability for future purchases.

5. KITs
Within Proovl, you may purchase a KIT.
A KIT is a service package that includes the rental and maintenance of equipment or infrastructure used to support SMS functionality for a mobile number.
A KIT is intended to support SMS receiving and, where approved, SMS sending, subject to technical availability.
A KIT does not include the sale, assignment, registration, transfer, or legal control of any phone number.

6. Phone Numbers
Proovl does not sell, assign, register, transfer, or provide ownership rights in phone numbers.
Any phone number used with a KIT must be owned or lawfully controlled by you or by the applicable end user.
You may also provide a phone number of your choice for use with a KIT. In this case, you are responsible for ensuring that the number has active roaming in Estonia. You may submit the LPA link and valid PIN to Proovl through the designated form.
By using a KIT, you authorize Proovl to support the technical operation of that number for SMS receiving and, where approved, SMS sending.
Proovl may provide general information to help you obtain or maintain a phone number for use with a KIT. This information may be based on public sources, partner programs, operator arrangements, or other available sources.
Such support does not make Proovl the owner, seller, registrar, provider, or legal controller of the phone number.
You are responsible for maintaining your rights to any phone number used with a KIT and for ensuring that your use of that number is lawful.

7. KIT Delivery, Renewal, and Expiration
KITs are delivered automatically through Proovl.
The term, price, features, limitations, and purchase conditions of each KIT are shown on Proovl.com or inside your Proovl account.
The information shown at the time of purchase is the final individual offer for that KIT.
Each KIT automatically renews for a new term, and the applicable renewal cost is deducted from your account balance.
You are responsible for maintaining a sufficient Credit balance to cover KIT renewals.
Proovl may send reminders about upcoming KIT renewals if you have not disabled news and update notifications in your account settings.
These reminders are provided for convenience only. Failure to receive a reminder does not waive your responsibility to maintain a sufficient Credit balance or prevent KIT expiration.
If your account balance is not sufficient to cover the renewal cost, the KIT will expire and will be deleted from your account.
If you no longer wish to use a KIT, you may delete it from your Proovl account at any time.
A KIT may be renewed only while it remains active and available in your Proovl account.
An expired or deleted KIT cannot be restored, renewed, replaced, refunded, or recovered.
When a KIT expires, is deleted, or is otherwise lost, all services and functionality associated with that KIT also end, including any related number support, SMS receiving, and SMS sending.
When a KIT expires, is deleted, or is otherwise lost, the message history associated with that KIT, including all received and sent SMS records, may be permanently lost and cannot be restored.
After delivery, a KIT cannot be returned, canceled, exchanged, or replaced unless Proovl confirms a functional issue.
Any claim related to a KIT can be reviewed only while the KIT remains active, available, and not deleted from your Proovl account. If the KIT has expired, been deleted, or is otherwise unavailable, Proovl may be unable to verify the issue, provide a remedy, or consider the claim.

8. Prices, Discounts, and Promotions
Prices, discounts, promotions, Credit packages, KIT terms, service conditions, and available features are shown on Proovl.com or inside your Proovl account.
The information shown at the time of purchase is final and binding.
Proovl may change prices, discounts, promotions, KIT conditions, Credit packages, service limits, and available functionality at any time.
Changes do not create any right to a refund, compensation, price adjustment, restoration of expired Credit, or restoration of an expired or deleted KIT.

9. KYC and Verification
Proovl may request KYC, identity verification, usage details, supporting documents, or other information from you at any time.
KYC may be required to enable or continue SMS sending, verify lawful use, prevent abuse, protect service stability, comply with legal or operator requirements, or reduce service risk.
If you fail to complete KYC, refuse to provide requested information, or provide false, misleading, incomplete, or unverifiable information, Proovl may refuse, restrict, suspend, or terminate any Proovl functionality.

10. Acceptable Use
Proovl may be used only for lawful and personal purposes.
Commercial use of Proovl is not permitted unless expressly approved by Proovl in writing.
You may not use Proovl for any illegal, abusive, misleading, deceptive, harmful, fraudulent, unauthorized, or prohibited purpose.
For purposes of these Terms, illegal use includes any use considered unlawful under the laws of the Republic of Estonia or by Estonian law enforcement authorities.
You are responsible for ensuring that your use of Proovl complies with all applicable laws, regulations, operator rules, third-party terms, and these Terms.

11. SMS Receiving and Sending
Proovl provides SMS receiving and, where approved, SMS sending functionality.
SMS receiving and sending depend on mobile operators, routing conditions, number status, technical availability, regulatory restrictions, third-party platforms, anti-spam systems, sender behavior, recipient systems, and other factors outside Proovl’s control.
Proovl does not guarantee that any SMS will be received, sent, delivered, displayed, stored, accepted by a third-party service, or delivered on time.
SMS sending is not enabled by default. It is available only after successful KYC review and only if Proovl determines that the requested use is lawful, personal, technically supported, and acceptable.
Unless otherwise stated by Proovl, SMS sending is limited to no more than one message per 120 seconds.
For messages using the standard English alphabet, one SMS may contain up to 170 characters.
If a message contains Unicode characters, including non-Latin characters, emojis, or special symbols, one SMS may contain up to 65 characters.
Longer messages may be split, rejected, delayed, billed differently, or not delivered.

12. Prohibited Uses
The examples below are provided for clarity and are not exhaustive. Proovl may treat any unlawful, abusive, misleading, deceptive, harmful, fraudulent, unauthorized, or otherwise inappropriate use as a violation of these Terms, even if it is not specifically listed below.
You may not use Proovl, directly or indirectly, to:
- violate any law, regulation, court order, or government requirement;
- mislead, deceive, impersonate, or defraud any person or organization;
- send spam, unsolicited messages, bulk messages, promotional messages, or commercial advertising;
- harass, threaten, abuse, intimidate, or harm any person;
- send false, misleading, fraudulent, unlawful, or harmful content;
- bypass, abuse, or interfere with phone verification systems, online services, apps, marketplaces, financial services, or social networks;
- create fake identities, fake accounts, or misleading registrations;
- collect, harvest, verify, or validate personal information, phone numbers, accounts, or user data without authorization;
- infringe privacy rights, intellectual property rights, publicity rights, or other rights of any person or organization;
- send malware, phishing links, harmful URLs, or content designed to compromise security;
- interfere with, disrupt, overload, or damage Proovl systems, partner networks, mobile operators, or third-party infrastructure;
- engage in any activity that may expose Proovl, its partners, mobile operators, or other users to liability, penalties, sanctions, complaints, or reputational harm.

13. Violations
Any violation of these Terms may result in immediate action by Proovl.
This action may include suspension or termination of SMS sending, SMS receiving, KITs, account access, or all services.
A violation may also result in the loss of any remaining Credit balance, refusal of future service, and recovery of any damages, losses, penalties, liabilities, costs, or expenses caused by the violation.
Proovl may take action without prior notice if it believes immediate action is necessary to protect Proovl, the Service, other users, partners, operators, or third-party systems.

14. Customer Responsibility
You are fully responsible for your use of Proovl and for all activity under your account.
You are responsible for all messages sent or received through your account, the purpose and legality of your use, and your lawful rights to any phone number used with a KIT.
You are also responsible for any claim, complaint, penalty, damage, loss, cost, or liability caused by your use or misuse of Proovl.
Proovl is not responsible for your actions, your message content, your communications with third parties, or any consequences resulting from your use of Proovl.

15. Support and Claims
Proovl provides support through the Support page available inside your Proovl account.
You may submit one support request at a time. After Proovl responds to your current request, you may submit a new request if further assistance is needed.
Proovl aims to respond to support requests within 48 hours, although responses are often provided sooner.
You are responsible for providing accurate and complete information needed to review any support request, technical issue, payment issue, KIT issue, or other claim.
Support does not create any right beyond those expressly stated in these Terms or any other applicable Proovl policy.
Proovl may refuse, suspend, or limit support if your communication or request is abusive, threatening, offensive, discriminatory, harassing, misleading, incomplete, related to prohibited use or account violations, or likely to expose Proovl, its users, partners, operators, or third-party systems to risk.

16. No Service Guarantee
Proovl is provided on an “as is” and “as available” basis.
Service availability may depend on mobile operators, equipment, routing, technical conditions, number status, regulatory restrictions, third-party services, and other factors outside Proovl’s control.
Proovl does not guarantee uninterrupted service, error-free operation, SMS delivery, SMS receipt, continued availability of any KIT, continued availability of any phone number, compatibility with any third-party platform, or availability of any specific SMS route.

17. Changes to These Terms
Proovl may update these Terms from time to time.
Proovl may also change prices, Credit packages, KIT conditions, Premium eligibility, SMS limits, service functionality, technical requirements, and available features.
Updated Terms will be published on Proovl.com or made available inside your Proovl account.
Your continued use of Proovl after the updated Terms become available means that you accept the updated Terms.

18. Governing Law
These Terms are governed by the laws of the Republic of Estonia.
Any dispute arising out of or relating to these Terms, Proovl, your account, Credit, KITs, or your use of Proovl will be handled by the competent courts of Estonia, unless mandatory applicable law requires otherwise.
